Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Tradesistency. By creating an account or using the service, you agree to them. Please read them carefully — they include a risk disclosure, a limitation of liability, an indemnification obligation, and a binding arbitration clause with a class-action waiver.

1. What Tradesistency is (and is not)

Tradesistency is a trade-journaling, discipline-tracking, and educational platform. It helps you log trades, set rules, track behavior and consistency, upload proof, and practice on delayed or simulated data.

Tradesistency is not a broker, exchange, prop firm, investment adviser, or signal service. It does not provide financial, investment, tax, or legal advice, does not recommend specific trades, and does not execute orders, route trades, or hold, transfer, or manage any funds or assets.

2. No financial advice

Nothing in the service is financial, investment, tax, or legal advice, or a solicitation or recommendation to buy, sell, or hold any security, future, or other instrument. Any analytics, AI-generated reports, coaching feedback, educational content, or practice tools are for informational and self-review purposes only. You are solely responsible for your own trading decisions. Consult a licensed professional before making financial decisions.

3. Trading risk disclosure

Trading futures, options, and other leveraged products involves substantial risk of loss and is not suitable for everyone. You can lose more than your initial investment. Past performance — yours, a strategy’s, or anyone else’s — does not guarantee future results. Any hypothetical, simulated, or paper-trading results have inherent limitations and do not represent actual trading. You accept full responsibility for your trading activity and its outcomes.

4. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use Tradesistency. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

5. Acceptable use

You agree not to:

  • break the law or infringe others’ rights while using the service;
  • access other users’ data or attempt to bypass security or authorization;
  • disrupt, overload, scrape, or reverse-engineer the service except as permitted by law;
  • upload malware or content you do not have the right to share; or
  • resell or misrepresent the service.

6. Market data and practice mode

Market data shown in the platform is provided by third parties and is typically delayed or indicative. It may be inaccurate, incomplete, or unavailable, and it must not be relied on for live trading decisions. Practice and paper-trading features use delayed or simulated data and never place real orders.

7. AI features

Optional AI features generate reports and coaching feedback from the data you provide. AI output can be wrong, incomplete, or misleading, is informational only, and is not advice. You should independently verify anything you rely on.

8. Subscriptions, refunds, and chargebacks

Tradesistency offers two paid plans, billed monthly or annually (“TC Monthly” and “TC Annual”). Applicable prices, billing intervals, and trial terms are presented at the point of purchase and are incorporated into these Terms. You authorize us and our payment processor to charge your selected payment method on a recurring basis until you cancel. We may change pricing prospectively with notice.

Refunds. You may request a refund within three (3) calendar days of the charge being processed. Requests made after that three-day window will not be honored. To request a refund within the window, contact Support.

Chargebacks. Initiating a chargeback or payment dispute with your bank or card issuer, instead of requesting a refund through Support within the three-day window, is treated as account abuse. Any account that files a chargeback will be permanently banned from the platform, and the IP address associated with that account will also be permanently banned, regardless of the outcome of the dispute.

9. Your content and our intellectual property

You retain ownership of the trades, notes, and files you create (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate the service for you. The Tradesistency platform, software, branding, and educational materials are our property or our licensors’ and are protected by intellectual-property laws; you may not copy, redistribute, or create derivative works from them except as permitted.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any data will be accurate. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Tradesistency and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, trading losses, data, or goodwill, arising out of or relating to your use of the service. Our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tradesistency and its owners, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the service; (b) your trading decisions and their outcomes; (c) Your Content; (d) your violation of these Terms or applicable law; or (e) your violation of any third party’s rights.

13. Governing law

These Terms and any dispute arising from them or the service are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. Subject to the arbitration provision below, the exclusive venue for any matter not subject to arbitration is the state and federal courts located in Texas, and you consent to their personal jurisdiction.

14. Binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. You and Tradesistency agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved exclusively by final and binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court if it qualifies. The arbitration will be conducted on an individual basis; class, collective, consolidated, and representative actions are not permitted, and you and Tradesistency waive any right to a jury trial. The arbitration will take place in Texas (or by remote/video proceeding where available) and be governed by the U.S. Federal Arbitration Act. If any part of this section is found unenforceable, the remainder will still apply to the fullest extent permitted by law.

15. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the service. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, governing law, and arbitration — will survive.

16. Changes to these Terms

We may update these Terms as the product and the law evolve. We will update the effective date and, for material changes, provide additional notice. Your continued use after an update means you accept the revised Terms.
